Brian explains the mechanics: the rule would let the federal government cross-reference state voter rolls against its own citizenship data and instruct the Postal Service to withhold ballots from anyone not on its approved list, all without congressional authorization for the president to control the time, place, and manner of elections, a power the Constitution gives to the states. Shant highlights the contradiction at the center of Solicitor General John Sauer's latest filing, which calls the rule a "modest envelope design requirement" in one breath and claims blocking it "nullifies" efforts to stop voter fraud in the next, despite no evidence of mail voter fraud existing in the record. Brian and Shant note the timing: Alabama and North Carolina ballots were already set to go out September 4th and 9th, meaning any last-minute rule change creates a logistical nightmare state election officials can't realistically absorb. Shant's bottom line: losing the same argument three times isn't persistence, it's a deliberate strategy to disenfranchise voters by running out the clock before November. Trump HAUNTED in COURT by J6 SLUSH FUND as Judge INTENSIFIES PROBE!!!
Attorneys Brian Kabateck and Shant Karnikian cover a federal judge's order compelling the Trump DOJ to disclose who created and controls the $1.776 billion "anti-weaponization" fund, after a fired January 6th prosecutor and a wrongfully arrested immigration protester sued, arguing the fund is designed to compensate only pro-Trump "victims of lawfare" while excluding people victimized by the Trump administration itself. Brian breaks down the parallel fight over the IRS immunity deal Trump struck with himself after dropping his own $10 billion lawsuit against the agency he oversees, shielding him, his family, and his businesses from future tax audits. Shant walks through the receipts proving the fund isn't actually dead despite Acting Attorney General Todd Blanche's Senate testimony: Trump telling reporters at Camp David he wishes the fund weren't dead, pushing Blanche to codify it by statute the same day, and Associate AG Stanley Woodward telling Reuters that January 6th defendants can still submit individual claims outside the formal fund. Brian explains the legal sleight of hand: normal statute of limitations rules would bar most January 6th-related claims by now, yet the DOJ has quietly kept the door open, having already paid Ashli Babbitt's family $5 million and Michael Flynn a separate settlement with zero outside guardrails on future payouts.
